There are two basic legal categories as follows:

 

Civil law: This general category of law covers all legal issues that do not involve criminal activity or the actual violations of the law. Generally, one party sues another because they have been wronged in some way and want a certain type of compensation for that wrong. Civil law also includes legal agreements, real estate transactions, divorces, child custody, probate, wills, trusts and estate planning.  It also encompasses various other matters where legal paperwork and administration is necessary to protect all parties involved.

 

Criminal law: This category of law relates to offenses that violate the laws of a local, state, or federal government. The prosecution is handled by government employed lawyers of that government entity, and the defense is handled by either a publicly appointed defender, or a private defense attorney whom the defendant hires to represent them in the defense of the charges alleged.

Petition for Writ of Certiorari to the Fourteenth Court of Appeals for the State of Texas. Motion for rehearing on Supreme Court denial of Petition.

Issue: Whether Texas Courts, under the supreme law of the land and  U.S.  Treaties,  may capriciously substitute its opinion to titles of Philippine aliens to estate of deceased Philippine domiciliary, who died in Texas while receiving medical treatment.

Issue: Whether royalty payments received during marriage from inventions patented before that marriage should be classified as community or separate property? Issue of first impression; characterized as community income, not separate as in oil/gas royalty: Appealed and affirmed. New Law.

Boyiddle vs. Amica Mutual Insurance Company

Mediation

Several years ago I began to expand my law practice by developing an alternative dispute resolution (ADR) mediation practice to better serve my current and future clientele.  This new aspect of my practice is aligned with the current trend of mandatory mediation requirements by many county, district and federal courts in  Texas.  This mandatory requirement to mediate conflicts and disputes, before you are allowed to proceed to litigation is the court’s attempt to clear the court’s dockets  and save the parties the enormous expense  of trial litigation.

 

The second facet of our mediation service, beyond the court referrals, is our ability to facilitate the resolution and settlement of any dispute or conflict between parties, both individual and commercial
